TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the EDM Realm mobile application (the "App"), our website at edmrealm.com (the "Site"), and related services (collectively, the "Services"). The Services are operated by EDM Realm ("EDM Realm", "we", "us", or "our").
Acceptance of the Terms
By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
Eligibility
You must be at least 13 years old to use the Services. If you are under the age of majority in your jurisdiction, you may use the Services only with consent and supervision of a parent or legal guardian.
Accounts and Security
You may need an account to access certain features. You agree to provide accurate information, keep your account information current, and maintain the security of your credentials. You are responsible for all activity that occurs under your account.
App Permissions
The App may request permissions such as location, photos, or notifications to enable features like nearby events, profile images, and alerts. You can control these permissions in your device settings, but disabling them may limit functionality.
User Content and Community
The Services may allow you to submit content, such as event submissions, flyers, posters, images, comments, messages, or profile information ("User Content"). You retain ownership of your User Content, but you grant EDM Realm a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute your User Content (including event flyers and images) in the App and Site and to operate, improve, and promote the Services.
You represent and warrant that you own or have obtained all rights, permissions, and consents necessary to upload your User Content and grant the license above, and that your User Content does not infringe any third-party rights. We may remove User Content or restrict access to it at any time.
Acceptable Use
You agree not to:
- Violate any law or regulation;
- Post unlawful, harmful, or infringing content;
- Harass, threaten, or impersonate others;
- Send spam or unsolicited promotions;
- Interfere with, disrupt, or attempt to gain unauthorized access to the Services; or
- Reverse engineer, scrape, or misuse the Services without our written permission.
Intellectual Property
The Services and all content and materials (excluding User Content) are owned by EDM Realm or our licensors and are protected by intellectual property laws. You may not use our trademarks or materials without our prior written consent.
Third-Party Services
The Services may include links to third-party sites or services, such as ticketing providers, maps, or social networks. We do not control and are not responsible for those third-party services or their content.
Feedback
If you provide feedback or suggestions, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use them without compensation.
Changes to the Services
We may update, modify, or discontinue the Services or these Terms at any time. We will post updates to the Terms on the Site and update the effective date above. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
Termination
We may suspend or terminate your access to the Services at any time for any reason, including if we believe you have violated these Terms.
Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EDM REALM WILL NOT BE LIABLE FOR ANY INDIRECT, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) IN THE 12 MONTHS BEFORE THE CLAIM.
Indemnification
You agree to indemnify, defend, and hold harmless EDM Realm and our affiliates, directors, officers, employees, and agents from any claims, losses, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your User Content, or your violation of these Terms.
DMCA Takedown Notices
We respect the intellectual property rights of others. If you believe content on the Services infringes your copyright, please send a DMCA takedown notice to info@edmrealm.com with: (1) your physical or electronic signature; (2) identification of the copyrighted work; (3) identification of the material claimed to be infringing and its location (URL); (4) your contact information; (5) a statement that you have a good faith belief the use is not authorized by the copyright owner, its agent, or the law; and (6) a statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
Apple App Store Terms
If you download the App from the Apple App Store, you acknowledge that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles.
